Withdrawal instructions for consumers
These instructions apply to contracts with STASTO Automation KG that you conclude as a consumer at a distance or away from our business premises. The German terms “Rücktritt” and “Widerruf” refer here to the same statutory right of withdrawal.
Right of withdrawal for purchases of goods
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period expires fourteen days after the day on which you, or a third party designated by you who is not the carrier, acquire physical possession of the goods. If you ordered several items in a single order and they are delivered separately, the period begins upon receipt of the last item. For goods delivered in several lots or pieces, the period begins upon receipt of the last lot or piece. For a contract for regular delivery of goods during a defined period, the period begins upon receipt of the first item.
To exercise your right of withdrawal, you must inform us — STASTO Automation KG, Feldstraße 9d, 6020 Innsbruck, Austria, telephone +43 512 52076, email austria@stasto.eu — of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal for purchases of goods
If you withdraw from this contract, we will reimburse all payments received from you, including delivery charges — except for the supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us — without undue delay and no later than fourteen days after the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back, whichever is earlier.
You must send back or hand over the goods to STASTO Automation KG, Feldstraße 9d, 6020 Innsbruck, Austria, without undue delay and in any event no later than fourteen days after the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the fourteen-day period has expired.
You bear the direct cost of returning goods that can normally be returned by post. For goods that, by their nature, cannot normally be returned by post, you bear return costs only if we informed you, before you placed your order, of this obligation and the amount of the costs or a reasonable estimate of their maximum amount. Otherwise, we bear those costs. If, when an off-premises contract was concluded, we delivered goods to your home that cannot normally be returned by post, we will collect those goods at our own expense.
You are liable for any diminished value of the goods only if it results from handling beyond what is necessary to establish their nature, characteristics and functioning. We do not charge a handling, restocking or cancellation fee for a statutory withdrawal. Prior authorisation and original packaging are not required.
Services
For a service contract, the withdrawal period is fourteen days from conclusion of the contract. The information above concerning the declaration of withdrawal and reimbursement applies accordingly; the rules on returning goods do not apply to contracts solely for services.
If you expressly requested that the service begin during the withdrawal period and were properly informed of the statutory consequences, you must pay us a reasonable amount if you withdraw. This corresponds to the proportion of the services already provided up to the time you inform us of your withdrawal, compared with the full scope of the services provided for in the contract.
For a paid service, the right of withdrawal expires early only after the service has been fully performed, provided you previously expressly consented to performance beginning before the withdrawal period expired and acknowledged that you would lose your right of withdrawal upon full performance of the contract. You will receive any confirmations required by law on a durable medium.
Exception for individually manufactured goods
There is no right of withdrawal for goods that are not prefabricated and for whose manufacture your individual choice or specification is decisive, or for goods clearly tailored to your personal requirements. Merely procuring a standard item, selecting a standard product variant or opening ordinary packaging does not remove the right of withdrawal.
Submit your withdrawal online
You can also submit your withdrawal online at www.stasto.eu/en/widerruf/erklaeren. Select “Withdraw from contract”, enter your name, information identifying your contract and your email address for the acknowledgement of receipt. Check your details and submit your declaration using “Confirm withdrawal”. You will promptly receive an email acknowledgement containing your declaration and the date and time it was received. Your other options for declaring withdrawal remain available.
